1. Platform Purpose & Limitations

Build Guild Club provides informational and planning tools for BMW performance enthusiasts. All content — including parts lists, cost estimates, power targets, compatibility checks, AI-generated recommendations, and community data — is provided for general planning purposes only. It does not constitute professional mechanical, engineering, legal, or safety advice.

Always consult a qualified tuner, certified mechanic, or licensed engineer before modifying any vehicle. Platform data may be incomplete, outdated, or inaccurate for your specific configuration. Guild AI recommendations are informational only and are not a substitute for professional diagnosis or advice.

2. Vehicle Modification Disclaimer

Modifying a vehicle carries significant risk to reliability, safety, and longevity. By using this platform you acknowledge and agree:

• Performance modifications can void factory and extended warranty coverage.
• Modifications increase maintenance complexity and cost proportionally. Higher power levels require more supporting components, more frequent service, higher-grade consumables, and more skilled labor to maintain safely.
• A build reliable at one power level may require additional investment in cooling, fueling, fasteners, sealing, and driveline components to remain reliable at higher targets.
• Modified vehicles may not be legal for street use in all jurisdictions. Emissions, noise, and safety laws vary by location. It is your responsibility to verify local compliance before modifying your vehicle.
• High-performance vehicles require proportionally higher driver skill. Modifications that increase output can make vehicles significantly less forgiving.
• Build Guild LLC is not responsible for any damage, injury, loss, or liability resulting from modifications made using platform guidance.

3. Membership Plans & Billing

Build Guild offers the following membership tiers:

• Club Member (Free): Access to the full Build Planner, Quick Cost Estimator, guides, and community forum. No payment required.
• Pro ($5/month): Includes Club access plus the basic Guild AI assistant. Basic AI provides requirements and compatibility guidance; it does not generate specific parts lists.
• VIP ($10/month): Includes Pro access plus advanced Guild AI — full build lists, custom recommendations, ongoing build advisor, and difficult issue diagnostics.

Pricing is subject to change. You will be notified of material pricing changes before they take effect. Paid subscriptions are billed monthly through Stripe. You may cancel at any time; access continues until the end of the paid billing period. We do not offer refunds for partial months unless required by law.

4. Guild AI Scope & Limitations

Guild AI (Pro and VIP tiers) is a build planning assistant. It is not a certified mechanic, licensed engineer, or professional tuner. AI-generated recommendations:

• Are based on general platform knowledge and the information you provide
• May not account for your specific vehicle's history, condition, or regional parts availability
• Are not guaranteed to be accurate, complete, or safe for your configuration
• Should be verified with a qualified tuner before purchasing parts or performing modifications

VIP AI outcomes depend materially on the accuracy and completeness of user input. Build Guild LLC is not responsible for outcomes resulting from AI-guided build decisions.

5. Community Content

Community content (build logs, posts, comments, votes) is submitted by members and is not independently verified. We do not guarantee the accuracy, safety, or applicability of community-posted content to your build.

By submitting content you confirm it is accurate to your knowledge, does not contain offensive, defamatory, or illegal material, and does not infringe third-party rights. Build Guild LLC reserves the right to remove any content that violates these terms at our discretion, without prior notice.

6. Account Responsibility

You are responsible for maintaining the security of your credentials. All activity under your account is your responsibility. You may not share accounts, impersonate others, or use the platform for unsolicited commercial solicitation without prior written consent from Build Guild LLC.

Accounts found to be in violation of these terms may be suspended or permanently terminated without notice.

7. Prohibited Use

You agree not to:

• Scrape, crawl, or systematically download platform content without written permission
• Attempt to access accounts, systems, or data you are not authorized to access
• Post spam, advertisements, or promotional content not sanctioned by Build Guild
• Use the platform or Guild AI to give advice intended to bypass safety systems or cause vehicle damage
• Violate any applicable law or regulation in connection with your use of the platform

8. Intellectual Property

Platform content, tools, workflows, and design are the property of Build Guild LLC or its licensors. You may use the platform for personal, non-commercial build planning. You may not reproduce, distribute, or create derivative works from platform content without prior written permission.

Content you submit to the community remains yours. By submitting it you grant Build Guild LLC a non-exclusive, worldwide license to display and distribute it within the platform.

9. Limitation of Liability

Build Guild LLC and its operators, employees, and contributors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of this platform, including but not limited to vehicle damage, mechanical failure, personal injury, or financial loss resulting from build decisions made with the assistance of this platform or its AI features.

The platform is provided “as is” without warranty of any kind, express or implied. Use of this platform constitutes acceptance of all risks associated with vehicle modification.

10. Governing Law

These terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved in the courts of California.

11. Changes to These Terms

Build Guild LLC reserves the right to update these terms at any time. Material changes will be communicated via platform notification or email (if opted in). Continued use of the platform after changes are published constitutes acceptance of the revised terms.
